I en färsk rapport välkomnar EESK kommissionens förslag att se över EU:s Århusförordning och förbättra tillgången till administrativ och rättslig prövning i miljöfrågor för enskilda personer och icke-statliga organisationer.
Trots att Europeiska unionen varit part i Århuskonventionen sedan 2005 uppfyller den fortfarande inte fullt ut bestämmelserna om tillgång till rättslig prövning.
Den ändrade förordning som föreslås av kommissionen innebär ett steg framåt och är ett väsentligt verktyg för att genomföra EU:s gröna giv menar EESK, som på det hela taget välkomnade de föreslagna ändringarna i en rapport som antogs i januari.
Föredraganden Arnaud Schwartz varnade dock för kryphål i den nya förordningen, vilka EU-institutionerna kan komma att utnyttja för att undgå ansvar.
Vi stöder exempelvis inte kommissionens förslag om att undanta EU-akter som omfattar ”nationella genomförandeåtgärder”, eftersom det finns en verklig risk för att ett sådant undantag skulle upphäva eller urvattna kommissionens förslag.
Kommittén är dessutom bekymrad över reformen av ”mekanismen för intern omprövning”, som i den ursprungliga Århusförordningen gav icke-statliga organisationer rätt att begära prövning av förvaltningsåtgärder som vidtagits eller försummelser som begåtts av en EU-institution. Att organisationer i det civila samhället ges möjlighet att ansöka om omprövning först när genomförandeåtgärder har antagits skulle förhindra många, om inte de flesta, av EU:s åtgärder och försummelser från att öppnas för intern omprövning.
EESK uppmanar också kommissionen att underlätta tillgången till rättslig prövning för alla organisationer i det civila samhället.
”Arbetsmarknadens parter är nyckelaktörer i miljöfrågor och bör uttryckligen erkännas när det gäller tillgång till rättslig prövning”, betonade Isabel Caño Aguilar, EESK:s medföredragande. ”För att göra rättslig prövning tillgänglig i praktiken bör det civila samhällets organisationer inte drabbas av extra bördor, såsom ytterligare kostnader och byråkratiska åtgärder”, konstaterade hon avslutningsvis.
