This opinion is the EESC's contribution to the implementation of the European Democracy Action Plan (EDAP) published by the European Commission in December 2020. The EESC welcomes the document, which it views as both positive and necessary, and recommends that the European Commission add to it a specific pillar for the involvement of civil society and social partners and the promotion of labour democracy. Indeed, the EESC regrets that the EDAP has failed to address the important role of the social contract, social dialogue and collective bargaining in reducing inequalities and encouraging Europeans to embrace democratic ideals. The EESC also believes that greater emphasis should be placed on civil dialogue, and it therefore reiterates its call for the creation of an annual Civil Society Forum on Fundamental Rights and the Rule of Law (SOC/627).

In its own-initiative opinion, the EESC examines the extent to which existing EU company law currently serves as an "expedient" for the politically-desirable Green Deal and which gaps still need to be closed, in particular regarding corporate social responsibility obligations. The opinion aims at following-up on the European Commission's initiative on due diligence and broadening the debate on sustainable corporate governance interlinking the social, environmental and economic dimensions.

This opinion examines how European legislation on circular public procurement can combine the main purpose of the contract with environmental protection, greater attention to SMEs, sustainable local production and the protection of social rights. This can be achieved by seeking and favouring solutions with a lower impact on the environment throughout their lifespan.

The EESC believes that evidence based processes like Health Technology Assessment (HTA) that is a key driver for socio-economic growth and innovation in the Union can be achieved through cooperation between Member States at Union level aiming at a high protection of health for patients and ensuring the smooth functioning of an inclusive Single Market. It is concerned about the set timelines of implementation and especially the delayed application of three years and believes that for the benefit of the patients and cost-effectiveness this could be shortened. In order to achieve the promise of digital health and care, of which HTA is part, the involvement of civil society is crucial.

The opinion, presenting EESC's position on the four proposals of the Health package published by the European Commission in November 2020, supports and welcomes these initiatives but draws the attention on some elements.
The EU and Member States should ensure that everyone has equal access to quality, well staffed, well equipped health and social services. This is particularly important in the context of the COVID-19 pandemic which has deepened existing inequalities.
Special attention in future EU policies should be given to healthcare workers and the need to improve working conditions, including pay, recruitment and retention, as well as their health and safety.
The new EU health package should be combined with the roll-out of the European Pillar of Social Rights (EPSR), particularly its principles 12, 16, 17 and 18 and the Action Plan on the EPSR. It should also be part of achieving Sustainable Development Goal (SDG) 3.

The EESC welcomes the Communication as an essential and effective step to enable the digitalisation of justice. It is crucial to support Member States at national level in making this change by providing them not only with the necessary funding, but also with tools. With this support, the digitalisation of justice can be expanded at European level to create mechanisms facilitating closer cross-border cooperation between judicial authorities.

The EESC welcomes the proposed regulatory initiative, which will have an indirect positive impact as it simplifies and speeds up cross-border judicial procedures and cooperation, and will also contribute to improving the functioning of the single market. It is worth noting that e-CODEX is not limited to e-justice. In anticipation of the future, the EESC recommends including a provision to open up the possibility of other uses by other public administrations, including for example the transfer of e-health records.
The Communication stresses the EU's commitment to safeguarding an online environment providing the highest possible freedom and security, for the benefit of its citizens.

The landscape of digital services is significantly different today from 20 years ago, when the eCommerce Directive was adopted. Online intermediaries have become vital players in the digital transformation. Online platforms in particular have created significant benefits for consumers and innovation, but at the same time, they can be used as a vehicle for disseminating illegal content, or selling illegal goods or services online.
The Digital Markets Act addresses the negative consequences arising from certain behaviours by platforms acting as digital “gatekeepers” to the single market.
The EESC fully supports the European Commission's action plan on intellectual property as a very good and holistic approach to modernising the EU IP system. The EESC welcomes all measures to enforce the fight against IPR infringement, and the strengthening of the role of the European Anti-Fraud Office in the fight against counterfeiting.
