Trade agreements include "safeguard clauses", i.e. stabilisation mechanisms for certain sensitive products allowing for the temporary withdrawal of tariff preferences or other preferential treatment. In practice, such clauses have very rarely been invoked, and even then, only at a late stage, so that they lose any real effectiveness. This opinion will focus on the conditions required for the agile and responsive triggering of safeguard measures enabling European producers to overcome a sudden crisis caused by a price collapse, which would otherwise threaten their survival.
