Observations from the Business Community and Civil Society on the Revision of Regulation EU n. 651/2014 on State Aid (General Block Exemption Regulation – GBER)

Background  

The own-initiative opinion will focus on the forthcoming review of the General Block Exemption Regulation (GBER), one of the EU’s cornerstone instruments for State aid, which the European Commission plans to revise in the fourth quarter of 2026. The opinion will assess how the current GBER framework operates in practice and identify priorities for its simplification and modernisation, in light of the Commission’s completed public consultation and recent enforcement experience. It will examine the Commission’s stated objectives of reducing overly complex or disproportionate conditions and extending the scope of the GBER to cover additional categories of aid. In doing so, the opinion will reflect the concerns of business organisations and civil society regarding legal uncertainty, administrative burden and the need for a clearer, more coherent structure.
